Who Qualifies for Spousal Support?

Spousal support, otherwise known as alimony, is awarded in Texas to a divorcing spouse who meets the below qualifications:

The paying party was convicted of family violence during the 2 years preceding the divorce.

The other qualifications apply ONLY to marriages 10 years or longer:

The requesting spouse lacks adequate means to provide for his/her minimal needs and is unable to support himself/herself through appropriate employment due to an incapacitating disability.

The requesting spouse lacks sufficient property to provide for minimal needs and is the caretaker of a child who requires substantial care and personal supervision, making it necessary for that spouse to remain at home with that child.

The requesting spouse lacks sufficient funds to supply their minimal needs and lacks earning ability in the job market to provide for their minimal needs.
